You are being asked to write a class you cannot inspect, against a control environment you cannot verify, on a loss history that has barely started accumulating.

The two identical submissions

Two applicants describe the same governance: same policy language, same committee structure, same attestations, same broker narrative.

One has controls that fire on every decision and can show it.

One has a binder.

Nothing in the submission tells them apart, so you price for the weaker of the two and lose the better risk to whoever priced more optimistically, or you decline the class and watch it get written elsewhere, or you write it and carry an ambiguity you cannot reserve against.

The problem is not underwriting judgment, but that the application asks for representations while the risk lives in operation, and nothing currently converts one into the other.

Why the submission cannot answer the question

Governance representations are made by the insured, evidenced by the insured's systems, and retained by the insured.

When the systems in question are supplied by a vendor who also holds the logs, the chain gets longer without getting stronger.

At renewal, you are told the controls held.

At claim, you are told the same thing, by the party whose recovery depends on it, using records they control, reconstructed after the event that made them matter.

Every part of that is normal commercial behavior, and it is also the reason AI risk resists pricing.

What changes when control operation becomes observable

We issue signed, tamper-evident records of individual governed decisions, where tamper-evident means later alteration is detectable by anyone holding the record.

They are issued when the decision happens rather than reconstructed afterward, and their origin can be verified without depending on the insured's cooperation at the moment you need it.

At submission

The two identical applicants separate before binding rather than after loss, because demonstrated control shows up in the evidence rather than in the narrative.

At renewal

Continuity of governance is observable across the period, including across a model change or a platform substitution, which is exactly when control environments quietly degrade and nobody files a notice about it.

At claim

The record of what was authorized survives the incident, so adjustment turns on artifacts rather than on competing reconstructions and subrogation has something to work from.

In the portfolio

The evidence is structured and consistent across insureds, so exposure becomes comparable across a book rather than described differently by every broker.

The class that is currently unwritable

Some AI exposures are not uninsurable because the risk is too large, but because they are unpriceable, and they are unpriceable because control operation is unobservable.

Observability is the precondition for the product, so carriers that can see control behavior can build coverage others cannot quote at all, without pricing blind against adverse selection.

How carriers and brokers work with us

Most start with a single account, typically one on the edge of declinable, where the submission reads well and the underwriter's instinct says the file is thin.

Some engage on the product side first, working through what becomes writable once control operation is observable in a book.

Brokers tend to arrive from the other direction, with a client who cannot get quoted and no way to prove their governance is better than the class average.
